1. Scope of Applicability

These General Terms and Conditions (GTC) apply to all deliveries from Linde Eckstein GmbH + Co. KG, Webshop, to consumers (§ 13 BGB – German Civil Code).

3. Offer and Conclusion of Contract

3.1 The presentation of products in our online shop does not constitute a legally binding offer but an invitation to place an order. All offers are valid "while stocks last," unless otherwise stated for specific products. Errors excepted.

3.2 By clicking the "Submit Order" button in the final step of the ordering process, you place a binding order for the goods in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

We store the contract text and send you the order details by email. You can view the General Terms and Conditions at any time on this page. Past orders can be viewed in your customer account.

 

5. Right of Withdrawal and Withdrawal Instructions

5.1 Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us at:

by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract.

You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

5.2 Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earlier.

You must send back or hand over the goods to:

without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

 

6. Prices and Shipping Costs

6.1 The prices stated on the product pages include statutory VAT and other price components.

6.2 Within Germany, a flat shipping fee of €5.50 applies. To Austria, the flat shipping fee is €9.95. To Poland, Spain, and the Czech Republic, the flat shipping fee is €13.50. To Greece, Italy, Croatia, Portugal, and Cyprus, the flat shipping fee is €14.50. To Sweden, the flat shipping fee is €18.00.

Shipping is free for orders within Germany with a minimum order value of €39. To Austria, shipping is free for orders of €79 or more. To Poland, Spain, and the Czech Republic, shipping is free for orders of €99 or more. To Greece, Italy, Croatia, Portugal, and Cyprus, shipping is free for orders of €110 or more. To Sweden, shipping is free for orders of €140 or more.

7. Delivery

7.1 Delivery is available within Germany and to the following countries: Greece, Italy, Croatia, Austria, Poland, Portugal, Sweden, Spain, the Czech Republic, and Cyprus.

7.2 The delivery time is up to 8 days.

 

8. Payment

8.1 Payment can be made via Sofortüberweisung or PayPal Checkout (PayPal, SEPA direct debit, giropay, SOFORT, debit or credit card).

8.2 When paying by credit card, your card will be charged upon completion of the order.

 

9. Retention of Title

The goods remain the property of Linde Eckstein GmbH + Co. KG until full payment has been received.

 

10. Warranty and Liability

10.1 Defective goods will be remedied by Linde Eckstein GmbH + Co. KG within a reasonable period by delivering non-defective goods. If subsequent performance fails, is unreasonable for the customer, or is refused by Linde Eckstein GmbH + Co. KG for justified reasons, the customer is entitled to the statutory rights of withdrawal or reduction and, if applicable, to compensation for damages and reimbursement of expenses as described below.

10.2 Liability for damages due to slightly negligent breaches of duty is excluded, unless they relate to essential contractual obligations or damages resulting from injury to life, body, or health, or guarantees. Claims under the Product Liability Act remain unaffected. The limitation of liability also applies analogously to breaches of duty by our vicarious agents and legal representatives.

This Agreement is executed in multiple languages for convenience only. In the event of any inconsistency or discrepancy between the German version and any translation, the German version shall prevail and be deemed the binding and controlling version for all purposes.
